Hyderabad: The Hanamkonda District Court’s handling of BJP state president Bandi Sanjay’s bail application was pending until late Thursday night as both sides argued over the petition beyond the court session. Earlier, the Hanamkonda court had released the police application seeking to detain Bandi Sanjay until Monday, opening up a fresh round of debate over whether he could be released on bail after the police custody application was issued until Monday.
In the High Court, Chief Justice Ujjal Bhuyan issued a notice to the state police to respond to Sanjay’s request to revoke the District Court’s order to remand him in judicial custody, while saying that Sanjay is free to submit a motion to bail if required Apply. Sanjay’s lawyer, N Ramchander Rao, argued that the magistrate failed to see whether Section 41-A of the Criminal Procedure Code and the guidelines laid down by the Supreme Court in Arnesh Kumar v Bihar were violated.
He also argued that the magistrate erroneously concluded that evidence would have been tampered with if the petitioner were let out. He claimed the remand was “unlawful” and that the magistrate “did not use his mind properly”.
According to the police, Sanjay was arraigned as the lead accused based on the confession of Accused No. 2, a former TV journalist who is currently an active member of NaMo, a front group of the BJP.
