SC grants bail to Munawar Faruqui, club FIR, transfers them to Indore

New Delhi: The Supreme Court on Monday granted bail to comedian Munawar Faruqui as he was registered by the Madhya Pradesh police as a case for allegedly hurting religious sentiment.

Judges BR Gavai and Sanjay Karol also consolidated all complaints against the comedian and transferred them to Indore in Madhya Pradesh.

In its order, the Supreme Court said, “Considering the facts and circumstances, and the previous orders of this Court, we are inclined to refer all complaints to Indore. We have granted interim protection, also absolute.” He has three weeks of protection against the display of a search warrant by the Delhi Police.

The Supreme Court’s order follows Faruqui’s petition to the Madhya Pradesh High Court to deny his bail and seek to dismiss all FIR and criminal proceedings against him in the case.

The request also seeks to consolidate the FIR.

Earlier, the Supreme Court had granted interim bail for Farooki, who was arrested by Madhya Pradesh police in the case.

The Supreme Court had also earlier stayed the production order issued by the Allahabad court against Farooki.

Gujarat resident Faruqui has been accused of making “indecent” remarks about Hindu gods during a performance.

The High Court rejected the bail request, having said a person’s liberty must be “balanced” with his responsibilities to other citizens.

Faruqui and four others were arrested on January 1, 2021, following a complaint by Eklavya Singh Gaud, son of BJP MLA Malini Laxman Singh Gaud, that he made references to Hindu deities and Union Home Minister Amit Shah during a comedy show at a cafe. Offensive remarks on New Year’s Day in Indore.

Another person was later arrested.
