New Delhi: On Tuesday, the Narcotics Control Board (NCB) informed the Supreme Court that it would not award actor Rhea Chakraborty ( Rhea Chakraborty’s bail was contested. Portrait of actor Sushant Singh Rajput.

Another Solicitor General, SV Raju, told Judges AS Bopanna and MM Sundresh that the NCB will not challenge the bail but the legal question regarding Section 27-A of the Narcotic Drugs and Psychotropic Substances (NDPS) Act should remain open.

“We are not challenging the bail bond but leave it open for consideration as to the interpretation of the clause. The Supreme Court agreed and dealt with the government’s appeal while clarifying that the Bombay High Court order will not be taken as precedent.

The Supreme Court is hearing NCB’s petition against the Mumbai High Court’s October 2020 order granting bail to Rajput girlfriend Chakraborty.

The NCB charged Chakraborty under the strict Section 27-A of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, which deals with financing and harboring illicit drug trafficking.

The article provides for a maximum penalty of 10 years’ imprisonment and prohibits the granting of bail. Merely paying for a particular drug deal does not amount to funding drug trafficking, the High Court said.

On June 14, 2020, 34-year-old Rajput was found hanged in his apartment on the outskirts of Bandra. After Rajput’s parents registered a case against Chakraborty for allegedly abetting suicide, a parallel investigation into her alleged drug sourcing was also started. Her WhatsApp chat history.
