New Delhi: On Wednesday, the Supreme Court rejected a petition to prevent Justice DY Chandrachud from being sworn in as India’s 50th chief justice on November 9.
The judges, led by Chief Justice UU Lalit of India, told the petitioner’s lawyers that “we see no reason to accept the petition, it has been misunderstood” and dismissed the petition.
At the hearing on the matter, the petitioner’s lawyer cited certain “irregularities, illegal acts” that Judge Chandrachud allegedly committed. The bench, which also includes Justices S. Ravindra Bhat and Bela M. Trivedi, told lawyers: “We don’t see any substance in this petition.”
In a case related to Covid vaccinations, lawyers have argued that Justice Chandrachud’s bench allowed marking when a senior defender appeared, but not when a junior defender appeared.
He further argued that Justice Chandrachud’s bench heard a petition for special leave arising out of an order of the Bombay High Court that his son had appeared as a lawyer.
The petition is based on a statement made by a Rashid Khan Pathan against Justice Chandrachu in front of the Indian President.
The Bar Association of India (BCI) and the Supreme Court Bar Association (SCBA) issued a statement condemning the letter against Justice Chandrachu.
On Wednesday morning, the petitioners’ lawyers referred to the urgent list of petitions before the bench led by Chief Justice Lalit. Lawyers said the oath was due on Nov. 9 and called for an urgent listing.Supreme Court lists matter for hearing at 12:45 p.m.
