Hyderabad: The Supreme Court has agreed on Monday to review the pleas of three people arrested by Telangana police for allegedly trying to poach the priorities of the ruling Telangana Rashtra Samiti (TRS). The three accused – Ramachandra Bharti, Kore Nandu Kumar and DPSKVN Simhayaji all approached the Supreme Court to challenge the arrest.
Judges BR Gavai and BV Nagarathna asked the trial court to also consider the defendant’s bail request as it had scheduled a further hearing of the matter on November 7. The defendants filed their case in the Supreme Court, claiming that the cases against them were politically motivated.
On October 29, the Telangana High Court reversed the order of the trial court after the Cyberabad police filed a criminal amendment application. Justice Chillakur Sumalatha has set aside an ACB Special Court judge’s order denying the remand of the three accused in the MLA poaching case.
However, High Court Judge B Vijaysen Reddy passed an interim order instructing police to suspend ongoing investigations while hearing a petition filed by the BJP asking the CBI or the Special Investigation Unit to investigate the poaching case.
During the debate, the Supreme Court delivered an oral opinion questioning whether the BJP needs to file a written petition to the High Court rather than those facing charges. The Supreme Court also sought to understand on what basis the High Court considered the petition.
However, the petitioners’ senior advocate KV Viswanathan said they had nothing to do with the BJP’s petition in the High Court. He said the petitioners suffered needlessly because of the fight between TRS and BJP. He made it clear that they did not know the purpose of the BJP’s petition to the High Court. Senior lawyer Siddhartha Ludra argued the case on behalf of the state government.
