Supreme Court says it will consider Section 370 challenge

New Delhi: The Supreme Court said on Wednesday it would consider for hearing a batch of petitions challenging the repeal of Section 370 and the division of the erstwhile state of Jammu and Kashmir into two union territories.

“We will review and give a date,” said Chief Justice DY Chandrachud and Justice PS Narasimha, as one of the petitioners in the case sought early listing of the matter.

The Supreme Court is hearing various petitions challenging the validity of the law that abolished Article 370 of the constitution and the special status of Jammu and Kashmir and split the state into two union territories.

Later, a number of petitions were filed against the government’s demarcation action under the Jammu and Kashmir Reorganization Act 2019.

The petitions say the center is bringing about sweeping changes affecting the rights of vast numbers of people. Although the petition has been pending before the Supreme Court since 2019, the central government has taken some irreversible actions.

The petition said the center had set up a demarcation committee to delineate the territorial boundaries for all constituencies ahead of parliamentary elections.

On 5 August 2019, the central government announced its decision to revoke the special status granted to Jammu and Kashmir under Article 370 and split the region in two.

In March 2020, a five-judge bench refused to bring before a larger seven-judge bench a batch of petitions challenging the constitutional validity of the Center’s Aug. 5 decision to repeal Section 370. Sex, saying there was no reason to refer the matter to a larger bench.

Numerous petitions have been filed in the Supreme Court, including individuals, lawyers, activists, politicians and political parties challenging the Jammu and Kashmir Reorganization Act 2019, which divides Jammu and Kashmir into two union territories – Jammu and Kashmir, and Ladakh.
