New Delhi: Google said on Friday it had approached the National Company Law Appellate Tribunal (NCLAT) over the Rs 1,338 crore penalty imposed by the Competition Commission of India (CCI) against the tech giant for abusing its dominance in several markets in the Android mobile device ecosystem. decision to appeal.

In a statement to IANS, Google said it had decided to appeal the CCI’s decision on Android because “we believe this represents a significant setback for Indian users and businesses who trust Android’s security features, and could raise the profile of mobile devices.” cost”.

“Android has greatly benefited Indian users, developers, and OEMs, and has driven India’s digital transformation. We look forward to making our case and remaining committed to our users and partners,” a Google spokesperson said.

India’s anti-competition watchdog also fined Google a second time in October — this time around $113 million (Rs 936 crore) — for abusing its dominant position over Play Store policies.

CCI directs Google to cease and desist from indulging in anti-competitive practices.

Google strongly opposed the CCI’s decision, saying it was taking all appropriate legal steps to defend the country’s Android business model.

Google is optimistic that “NCLAT will fully consider the documented evidence and Android’s enormous contribution to the massive growth and prosperity of the Indian mobile ecosystem”.

According to the company, Android creates more choice for everyone and supports thousands of successful businesses in India and around the world.

The appellate court will consider “the irreparable harm that Android stakeholders face if the stay is not granted pending the outcome of the appeal,” the company said.

Not only Google, but even some Indian mobile phone manufacturers disagree with CCI’s remedy because it has obvious adverse effects.

India is Google’s largest user market.
