New Delhi: On Thursday, the Supreme Court reserved the Uttarakhand High Court’s directive to clear Haldwani’s 29-acre railway land encroachment.
The Supreme Court issued notices to the railway company and the state government to respond to a batch of requests challenging the High Court’s order to clear encroachment rights.
According to statistics from the railway department, there were 4,365 encroachers.
Judges SK Kaul and AS Oka considered it an “artificial problem” that needed to find some workable solutions.
The Supreme Court has posted the matter for further hearing on 7 February.
On December 20 last year, the High Court ordered the demolition of buildings on the encroached railway land in Haldwani Banbhoolpura.
It has directed that the trespassers be notified within a week, after which the encroachment should be demolished.
In their plea, the residents said it was gravely wrong for the High Court to pass the challenged order knowing that proceedings concerning the ownership of the residents, including the petitioner, were pending before the magistrate. The 29 acres of allegedly encroached railway land in Banbhoolpura are dotted with places of worship, schools, commercial establishments and residences.
