Hyderabad: Under Section 41-A of the Criminal Procedure Code, the Telangana High Court has ordered the suspension of the notification to BJP National Secretary-General BL Santosh by the special investigation team investigating the MLA poaching case.
The court issued the stay order after Santosh filed a request to the court to withdraw the notice because it did not mention the grounds for his subpoena.
The court stayed the notice for lack of essential elements, noting that a notice under section 41-A must state the evidence or suspicion or grounds for summoning the person.
According to Prakash Reddy, a senior counsel representing Santosh, the SIT did not mention any of these in the notice.
