Hyderabad: Telangana High Court Judge B Vijaysen Reddy on Wednesday reserved a batch of writ requests related to the MLA poaching case for order. Senior Adviser J Prabhakar presented his arguments on behalf of the BJP Telangana wing. He said that under the Prevention of Corruption Act, neither the SIT, the Moinabad police nor the ACP had the authority to investigate. He said even the governor who appointed SIT did not mention the Prevention of Corruption Act but was appointed under the Code of Criminal Procedure.
Prabhakar also disputed the documents filed with the court, saying the documents filed now are different from those before December 1. Regarding the argument that the police had improperly taken the complainant’s statement under Section 164 of the CrPC and sought an investigation by the CBI, the judge noted that there were no guidelines as to when a statement was recorded under Section 164. The judge also asked the Attorney-General for clarification on the GO’s appointment of SIT and adjourned the case until Thursday for clarification.
Actions against Punjagutta ACP
Judge B Vijaysen Reddy directed the Commissioner of Police to take disciplinary action against Assistant Commissioner of Police Punjagutta; and SR Nagar station officer K Saidulu.
K Madhavi filed a lawsuit challenging the inaction of officials in registering FIRs under the SC and ST (Prevention of Atrocities) Acts. Counsel T Swetcha, representing the petitioner, said the processing of the complaint had been delayed for a month. She said the FIR was registered only after approaching the High Court.
Under the Act, the official willfully neglected his duties and was punished with a six-month penalty. In addition, the lawyer said, it provides for severe measures against officials who make mistakes and are negligent. Referring to the counter, she noted that, admittedly, there were delays on the part of the police. The judge then directed the disciplinary proceedings and closed the case within two months.
Sharmila challenges confinement
Telangana YSRCP chairman YS Sharmila re-filed the case in the High Court on Wednesday in a lunch motion to challenge the confinement of her residence in Lotus Pond by the Telangana police.
The judge made it clear no restrictions could be imposed and directed police to allow her to vacate the residence. While the Home Ministry’s Government Advocate informed the court about incidents of meeting the Governor without his knowledge, Pragathi Bhavan and traffic jams causing inconvenience to the public, the judge directed Sharmila to obtain the necessary permission for holding public meetings and pujas in public places .
He also directed the police to make arrangements to ensure the smooth flow of traffic at the Banjara Hills lotus ponds. Accordingly, the judge dealt with the case.
