Hyderabad: The Telangana High Court on Monday set aside the Bendalapadu Grama Panchayat’s resolution against the Gutti Khoya tribe seeking to evict the tribe from the settlement of Yerrabodu.
Justice Lalitha Kanneganti, in a case brought by Kavasi Hadma and two other tribal residents of Bendalapadu village, questioned the authority of the Granma Village Council to pass the eviction order after the alleged death of Forest Range officer Ch Srinivas Rao in an attack. Later adopted by members of the Gutti Khoya tribe.
The petitioners argued that the Bendalapadu village council secretary and Sarpanch passed an unconstitutional order without even holding a grama council. The resolution wants to return the tribes to Chhattisgarh from where they migrated to Bundarapadu 40 years ago.
Plaintiffs’ lawyer Ambedkar argued that such an eviction order violates the 2018 Panchayat Raj Act and the 2006 Recognition of Forest Rights by Scheduled Tribes and Other Traditional Forest Peoples Act.
The court agreed with the petitioner that there were laws in place to deal with the crime and that the eviction was unlawful. Accordingly, the case was dealt with.
