    Historic First Under DRIPA – Tahltan Nation and B.C. Jointly Approve Eskay Creek Mine

    TERRACE — The Skeena region has become the site of a global precedent in Indigenous sovereignty and resource governance. In a series of historic announcements on January 26 and 27, 2026, the Province of British Columbia and the Tahltan Central Government (TCG) issued a dual authorization for the Eskay Creek Revitalization Project, marking the first time a major industrial project has been approved via a consent-based framework under the Declaration on the Rights of Indigenous Peoples Act (DRIPA).

    The Environmental Assessment Office (EAO) issued the project’s certificate on Monday, followed by the Mines Actpermit on Tuesday. This sequence effectively ends the era of “consultation” in favor of “consent,” elevating the Tahltan Nation from a stakeholder to a joint decision-maker with the power of veto.

    A New Legal Frontier: Section 7 and DRIPA

    The authorization is the culmination of a Section 7 agreement signed in 2022, which legally mandated that the project could not proceed without the free, prior, and informed consent of the Tahltan people.

    During a ceremonial signing in Vancouver, TCG President Kerry Carlick emphasized that the process was guided by the “Tahltan Risk Assessment,” a comprehensive review that wove Indigenous knowledge into Western scientific data. “This is reconciliation in action,” Carlick stated, noting that the agreement recognizes Tahltan jurisdiction as a matter of law, not just policy.

    Economic Superpower: The Gold-Silver Renaissance

    The redevelopment of Eskay Creek—a legendary underground producer that closed in 2008—into a modern open-pit mine is expected to be a massive economic engine for the Northwest.

    Beyond provincial taxes, the Tahltan Nation will benefit from a Mineral Tax Revenue Sharing Agreement, ensuring that wealth from the “Golden Triangle” is directly reinvested into local Tahltan infrastructure and community services.

    38 Binding Conditions: Protecting the Land

    The approval is contingent upon Eskay Creek Mining Ltd. (a subsidiary of Skeena Gold and Silver) adhering to 38 legally binding conditions. These were co-developed with the TCG to address specific cultural and environmental concerns:

    • Water & Fish: Continuous monitoring to ensure open-pit operations do not degrade the surrounding aquatic ecosystems.
    • Road Safety: Measures to reduce the strain on Highways 37 and 37A near Stewart and Bob Quinn Lake as ore concentrate is transported to the port.
    • Tahltan Way of Life: Protections for “quiet enjoyment of the land” and food sovereignty.

    Federal Environment Minister Julie Dabrusin finalized the “one project, one review” process by issuing a federal decision statement on January 26, concluding that the project’s socio-economic benefits and robust safeguards outweigh any potential negative impacts.
